In a Nutshell: We love when people use Funktion to enhance their events - but keep it legal, respectful, and free from shady dealings. Please don’t automate bots to spam the platform, harass other users, or engage in any behavior that breaks the law or violates our partners’ policies. If you’re running a CrowdFund campaign, remember you may be considered the merchant of record, so it’s on you to stay compliant. 1. Introduction
This Acceptable Use Policy (“AUP”) sets out the standards for what is and is not permissible when using the Funktion service (“Funktion” or the “Service”). The Service is provided by Crowd Tech Group, Inc. (“CTG,” “we,” “us,” or “our”) and is governed by this AUP in addition to our Terms of Service. The AUP applies to everyone (“Host”, “Guest”, “User” or “you”) who interacts with the platform, including both Hosts (who create and manage events) and Guests (who attend them).
We strive to maintain a positive, lawful environment on Funktion. If we believe a user’s conduct violates this AUP or any relevant third-party policies - such as those required by PayPal or Spotify - we may suspend or terminate access to the Service without advance notice.
2. Scope & General Principles
All users of Funktion must comply with the law and respect the rights of others. This basic rule means you should refrain from using the Service in ways that violate any statute, regulation, or ordinance, whether local, national, or international. Furthermore, we expect everyone to act with courtesy and refrain from harassing or discriminatory behavior. Should a user’s event incorporate any third-party integrations, such as PayPal or Spotify, that user must also adhere to those third parties’ terms.
3. Prohibited Uses & Activities
We prohibit unlawful or harmful conduct on Funktion and reserve the right to determine what constitutes a breach of this AUP. Users may not participate in activities that involve the sale or distribution of illicit substances, stolen goods, or other items restricted by law in their jurisdiction. Engaging in fraud or encouraging others to commit illegal acts is not allowed. Distributing hateful or harassing content, or promoting violence and discrimination, is equally unacceptable.
We also forbid the uploading or distribution of materials that infringe on others’ intellectual property or privacy rights, including copyrighted, trademarked, or otherwise protected works if you do not have permission to share them. Additionally, users should not deploy bots, scrapers, spam tools, or malicious code that could degrade or disrupt the functionality of the platform for others. Any attempt to gain unauthorized access to our systems, or to the accounts or data of other users, is strictly prohibited.
In the realm of financial transactions, you must avoid activities that PayPal designates as off-limits. This includes, but is not limited to, the sale or promotion of narcotics, cigarettes, stolen goods, or any venture that promotes or instructs on illegal activities. Similarly, schemes such as pyramid or ponzi arrangements, or multi-level marketing programs that violate PayPal’s terms, are not allowed. 4. Financial Transactions & Crowd-Funding
We recognize that some events on Funktion involve crowdfunding or payment collection. In such cases, the Hosts may act as the “merchant of record,” meaning CTG does not directly handle funds or assume merchant liabilities. Any Host who accepts payments through PayPal must do so according to PayPal’s rules and any applicable local regulations. This includes adhering to all laws governing charitable solicitations, fundraising, or commercial transactions. In the scenario where CTG is the merchant of record, CTG may charge a service fee to handle the transaction, and payouts to the intended recipient may be delayed in order to guarantee payments are not fraudulent and are not immediately disputed.
Any activity related to bribery, corruption, or financing of illegal undertakings is strictly prohibited. Similarly, certain transactions that require licenses or prior approval - such as gambling services or sales of regulated goods - must not occur on Funktion unless the user has obtained all relevant permissions. CTG does not mediate financial disputes between Hosts and their contributors. Matters of chargebacks, refunds, or related issues should be addressed through PayPal’s dispute resolution process or via applicable legal channels.
5. Enforcement & Consequences
We reserve the right to examine any user-generated content or behavior on Funktion to determine if it aligns with this AUP, our Terms of Service, and the law. If we conclude that a user has violated our policies, we may remove offending content, issue a warning, or implement account suspensions or terminations. This decision can be immediate and without prior notice.
In cases of serious violations, we may cooperate with law enforcement authorities or third-party investigators when warranted. Our judgment on these matters is final, although users who believe we have acted unfairly can contact us for clarification or reconsideration.
6. Relationship to Other Policies
This AUP is part of a larger legal framework that governs your use of Funktion. It is intended to complement, rather than replace, our Terms of Service. If any discrepancy arises between this AUP and the Terms of Service, the Terms of Service will generally prevail.
7. Changes to This Policy
We may update or modify this AUP from time to time to reflect changes in our Service, the legal landscape, or best practices. If we make significant updates, we will provide a clear notice on our website or through other communication channels. By continuing to use Funktion after any revised AUP takes effect, you agree to follow the updated policy. If you do not agree, you must discontinue using the Service.
