0. “tl;dr” Summary

Quick Overview: We at Crowd Tech Group, Inc. (providing the Funktion service) only collect the basics: IP addresses, analytics data, and login details if you choose to create an account. We are a small startup and are choosing to host all data in the EU. We don’t share your info with third parties, and we definitely don’t see or store your payment info - PayPal handles that. If you ever need us to delete your data, email us at privacy@usefunktion.com. We do use Google Analytics, but only to help us improve Funktion. And if you’re not an adult in your jurisdiction, please make sure your Host is okay with you joining any event. Read on for the finer details!

1. Introduction

This Privacy Policy explains how Crowd Tech Group, Inc. (“CTG,” “we,” “us,” or “our”) collects, uses, and protects the personal data of individuals who access or use the Funktion service (“Funktion” or the “Service”). CTG is a Delaware corporation.

By accessing or using Funktion, you agree to the collection and use of information as described in this Policy. If you do not agree, please discontinue using Funktion.

2. Data We Collect

2.1 Information from Hosts and Guests

  • IP Addresses and Session Data: Whenever you visit or interact with Funktion, our systems automatically log certain technical information (e.g., IP address, browser type, device identifiers, and session data).

  • Analytics Data: We use Google Analytics to gather statistics about site usage and user interactions. These analytics help us understand how people use Funktion and guide us in improving the Service.

  • Login Credentials: If you choose to log in through our third-party authentication integrations, we store your email address and display name (if provided by the login system).

  • Voluntary Submissions: Hosts and Guests can submit text or images at their events. In such cases, we collect only what you choose to provide. All of the voluntarily submitted data is only accessible within the context of those events (users connected to one event will not be able to access data about a different event they do not already have access to).

2.2 Payment Data

We do not directly process or store payment or financial information. If you use PayPal through Funktion (for crowdfunding or paying event fees), the transaction is handled by PayPal, subject to their own Privacy Policy.

2.3 Children’s Data

Funktion is intended for use by adults in the role of Hosts. However, Guests may include minors. We do not intentionally collect personal information from individuals under the legal age, and if a minor logs in for any reason, the Host is responsible for ensuring compliance with all applicable laws. If you believe that a minor has provided personal information without consent, please contact us so we can delete it.

3. How We Use Your Information

3.1 Service Operation

We use your data primarily to operate, maintain, and improve Funktion’s core features. This includes creating and managing events, logging in users using our integrated login platforms, and ensuring a smooth user experience.

3.2 Internal Analytics and Improvements

We rely on Google Analytics and similar technologies in the future to assess Service performance, diagnose technical issues, and refine our features. While we analyze user behavior to inform marketing decisions and product improvements, we do not use your data to perform personalized direct marketing.

3.3 Legal and Compliance

We may also use collected data to comply with applicable laws, regulations, and legal processes, or to enforce our Terms of Service and prevent fraudulent or illegal activities on the platform.

4. Cookies and Tracking Technologies

We use cookies and similar technologies to:

  • Identify User Sessions: Our cookies help maintain your session state, ensuring the Service functions correctly.

  • Analyze Traffic: Through Google Analytics, we gather aggregated data about user interactions.

These cookies do not contain personal information that we share with third parties. You can adjust your browser settings to block or delete cookies, but note that some features of Funktion may not work properly if you do so.

5. Data Retention

We retain anonymized or aggregated usage data for as long as needed for business and analytical purposes. For personal data (e.g., email addresses for logged-in users), we keep it only for as long as your account is active or as required by applicable laws. If you request data deletion, we will remove or anonymize your personal data in accordance with the process described below.

6. Data Subject Rights and Your Choices

You have the right to request a copy of any personal data we hold about you, and if you find that our records are inaccurate, you may ask us to correct those inaccuracies. You also have the right to request the deletion of your personal information. We will honor such a request unless we are legally required to retain the data (for example, to comply with a legal obligation). To exercise any of these rights, please contact us at privacy@usefunktion.com.

6.2 Withdrawal of Consent

If you have previously consented to any data processing, you have the right to withdraw that consent at any time by contacting us. However, withdrawing consent does not affect any processing conducted before the withdrawal.

7. International Data Transfers

We operate internationally and we store data on EU-based cloud servers. We also always take reasonable steps to ensure an adequate level of data protection following AWS hosting best practices.

8. How We Share Your Information

We take pride in not selling or otherwise sharing your personal information with third parties beyond what is necessary to operate Funktion. In particular:

  • Service Providers: We may engage trusted third parties to perform functions on our behalf (e.g., AWS for hosting, Google Analytics for metrics). They only have access to the information needed to carry out their tasks and are contractually obligated to protect it.

  • Legal Requirements: We may disclose personal data if required by law, court order, or other lawful request from governmental authorities, or if necessary to protect our rights, property, or safety.

We do not share user data with third-party advertisers or external marketing platforms for direct promotion, however we do utilize Google Analytics to monitor usage and behavior in order to improve our product.

9. Security Measures

While we do not store sensitive data such as payment information or detailed personal records, we still employ technical and organizational security measures to protect the data we do hold. This includes encryption in transit (e.g., HTTPS), secure AWS storage, and strict access controls. However, no system is 100% secure, and we cannot guarantee absolute protection against unauthorized access, hardware or software failures, or other unforeseen risks.

10. Additional Disclosures for Certain Jurisdictions

Although we do not specifically target California residents, we generally strive to align with privacy regulations. If you are a California resident, you may have additional rights regarding your personal data (such as under the California Consumer Privacy Act, “CCPA”). You can exercise these rights by contacting us at privacy@usefunktion.com

For EU residents or those located within the EU, we adhere to the General Data Protection Regulation (“GDPR”). If you have any questions or concerns about how we handle your personal data, or if you wish to exercise your GDPR rights, please email privacy@usefunktion.com

If you live in any other region with data protection laws that grant you certain privacy rights, please feel free to reach out to us as well. We will do our best to accommodate your requests, but we cannot guarantee that we will always be able to fulfill them in every circumstance.

11. Changes to This Policy

We may update or modify this Privacy Policy from time to time to reflect changes in our practices, technology, or legal requirements. When we make material changes, we will post a prominent notice on the Funktion website or otherwise notify you. By continuing to use Funktion after any changes take effect, you acknowledge and accept the updated Privacy Policy.

12. Contact Us

If you have any questions, concerns, or requests regarding this Privacy Policy or our data practices, please contact us at privacy@usefunktion.com.

Final Note

This Privacy Policy is part of our effort to be transparent about how we handle user data. By using Funktion, you agree to the terms of this Policy. If you have any doubts or concerns, feel free to reach out to us at any time.
